1. Introduction & acceptance

Welcome to MigosAI (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of MigosAI, an AI video generator that turns two photos into a short performance video, available at https://migosai.pro (the “Service”).

By creating an account, purchasing credits or otherwise using the Service, you confirm that you: (a) are at least 18 years old; (b) have read and agree to these Terms; (c) agree to our Privacy Policy and Acceptable Use Policy; and (d) are authorized to accept these Terms for yourself or for the organization you represent. If you do not agree, do not use the Service. Continued use after an update means you accept the revised Terms.

2. Service description

2.1 What we provide

MigosAI lets you upload two photos and generate a 8-second, 16:9, 720p video in which the two people from your photos perform side by side in a fixed scene: an orange studio backdrop with a hanging microphone. The scene, camera and performance are set by us; you cannot enter your own text prompts. The Service is a digital software-as-a-service product delivered over the internet.

2.2 Nature of the Service

The Service is digital and intangible. Credits are added to your account as soon as your payment is confirmed. Because delivery is immediate and digital, refunds are limited as described in Section 7.

2.3 Underlying AI model

Videos are generated with Seedance 2.0, a video generation model developed by ByteDance, accessed through a third-party API provider. Generation time and availability depend on that provider: a render usually takes a few minutes and can take longer when its queue is busy. We will tell users about significant disruptions when we become aware of them.

MigosAI is an independent product. It is not affiliated with, endorsed by or sponsored by ByteDance, Migos, Quality Control Music, or any related artist, label or rights holder.

3. Account registration & eligibility

3.1 Account creation

You need an account to generate videos. Provide accurate information. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security

• Tell us immediately at [email protected] if you notice unauthorized use of your account.
• Do not share your credentials with anyone.
• Keep your account email address up to date.

3.3 Business accounts

If you register on behalf of a company or organization, you confirm that you have authority to bind it to these Terms.

4. Credits

The Service runs on credits. One credit generates one video. New accounts receive 1 free credit. Additional credits are sold in one-time packs; current packs and prices are listed on our Pricing page.

Each account can start up to 3 generations in any 24-hour period, with one generation in progress at a time. If a generation fails, or is refused by the AI provider’s safety screening, the credit is returned to your balance automatically.

5. Billing & payment

5.1 One-time purchases

Each credit pack is a single, one-time payment. By completing a purchase, you authorize the charge of the amount displayed at checkout. We do not sell subscriptions, and we never charge your payment method automatically.

5.2 Payment processor

Payments are handled by Waffo Pancake, which acts as merchant of record and as our PCI-DSS-certified payment processor. You enter your card details on Waffo Pancake’s checkout page; they are never sent to or stored on our servers.

5.3 Taxes

Prices are in US dollars and exclude applicable taxes (such as VAT, GST or sales tax), which are calculated and collected at checkout where the law requires it.

6. Credit validity & account closure

6.1 Credit validity

Purchased credits do not expire while your account remains open.

6.2 Closing your account

If you close your account, any unused credits are forfeited. To get a refund for unused purchased credits, request it under Section 7 before you close your account. If we close your account for a reason other than your breach of these Terms, we will refund the purchase price of your unused purchased credits. Free credits have no cash value.

7. Refund policy

Credits that have been used to generate a video are non-refundable, with these exceptions:

• Unused purchase, within 7 days: a full refund if you ask within 7 days of purchase and no video has been successfully generated since that purchase.
• Duplicate or erroneous charge: a full refund.
• Failed generation: the credit is returned to your balance automatically — you do not need to ask.
• Statutory rights: where the law of your country grants a right of withdrawal (for example, the 14-day right in the EU and UK), that right is preserved. It ends once you use a purchased credit, to the extent the law allows.

To request a refund, email [email protected] with your account email and the order ID from your receipt. We reply within 2 business days and process approved refunds within 5–10 business days, to the original payment method.

8. Billing disputes

If you think a charge is wrong, please contact us at [email protected] before disputing it with your bank. We reply within 2 business days and resolve confirmed billing errors within 5 business days.

9. Your photos, AI output & intellectual property

9.1 Your photos

You may only upload photos of yourself, or of people who have given you permission to use their image this way. Never upload a photo of anyone under 18. By uploading a photo, you confirm that you have that permission.

9.2 Licence to process your photos

By uploading photos (“Inputs”), you grant us a limited, non-exclusive licence to store them and send them to our AI video provider, solely to generate the videos you request. We do not use your Inputs to train AI models.

9.3 Ownership of output

To the extent we hold any rights in a video generated for you (“Output”), you own them. An Output can contain elements that we do not own and cannot license to you — in particular, the likeness of the people in your photos and the soundtrack. Owning an Output does not give you rights in those elements, and you are responsible for securing any rights you need before using an Output commercially.

9.4 AI-generated content

Every Output is generated by AI. Do not present an Output as real footage of real events. Outputs may not match your photos exactly and may contain errors; we do not guarantee any particular result, and we are not liable for content produced by the third-party model.

10. Acceptable use

You may use the Service only for lawful purposes. You agree not to use it to:

• Generate content that is illegal, defamatory, harassing or fraudulent.
• Create a video of a real person without their permission, including celebrities, public figures and politicians, or use a video to impersonate someone or to deceive viewers about its origin.
• Upload photos of anyone under 18, or generate content that sexualizes minors.
• Infringe the intellectual property, privacy or publicity rights of any third party.
• Circumvent the Service’s safety screening, usage limits, credit system or other security features.
• Resell or sub-license access to the Service without our written approval.
• Use inputs, outputs or derivatives of them to train, fine-tune, benchmark or distil an AI model, or scrape outputs at scale.
• Violate any applicable law, regulation or card network rule.

11. Data, privacy & security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by Waffo Pancake and is not stored on our servers. You can ask us to delete your account, photos and videos at any time by emailing [email protected]; we do so within 30 days.

12. Disclaimers & limitation of liability

12.1 Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS.

12.2 AI-generated content disclaimer

Outputs are synthetic and may be inaccurate. Do not rely on them as a factual record of any person or event.

12.3 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Term & termination

These Terms apply for as long as you use the Service. We may suspend or close your account if you materially breach these Terms, if we suspect fraud, or if the law requires it. You may close your account at any time by emailing [email protected].

14. Governing law & disputes

These Terms are governed by the laws of the People's Republic of China. This does not take away any mandatory consumer protection you have under the law of the country where you live. Before starting formal proceedings, please contact us at [email protected] so we can try to resolve the issue informally.

15. General provisions

We may update these Terms. We will announce material changes by email or by a notice on the Service at least 14 days before they take effect. If any provision is found unenforceable, the rest remains in effect.
